General terms and conditions of business

 

1. Scope (valid from March 25, 2022)

These General Terms and Conditions (GTC) regulate the relationship between Piccolohouse KLG, Niederhaslistr. 4, 8105 Watt (hereinafter referred to as Piccolohouse), and their customers. Deviating agreements must be in writing to be valid.

2. Offer and delivery area

Piccolohouse's offer is aimed at customers residing in Switzerland or the Principality of Liechtenstein.

Piccolohouse's offers on the Internet or in advertising are subject to change and are not to be understood as binding offers. All product information, product photos, technical specifications, accessory relationships, etc. on the Internet or in advertising are provided without guarantee. The specifications published at the time of purchase are decisive.

3. Buy locally

A contract/purchase is concluded through a written order by the customer and subsequent order confirmation from Piccolohouse.

4. Purchase via the Internet

Orders are only placed via the online shop on the websitewww.piccolohouse.eu received and confirmed by email. Telephone or written orders will be processed on site according to the purchase. If, after the order has been confirmed, it is determined that an item is not available, the corresponding order will be canceled by Piccolohouse and the customer will be informed. The customer cannot assert any further claims.

5. Prices

All prices include value added tax (VAT) and other statutory fees such as Suisa and the advanced recycling fee (VRG) in Swiss francs (except for orders from business partners and other companies). Additional costs such as installation, assembly, additional materials, packaging, shipping, delivery costs and surcharges for certain means of payment and services are charged separately or as already listed in offers. Technical changes, errors and printing errors remain reserved.

Piccolohouse has the right to change the price at any time. The price shown on the website applieswww.piccolohouse.eu is shown or is offered on the offer. Price changes made after confirmation will not be taken into account.

6. Payment and retention of title

The purchase price will be transferred to Piccolohouse's account, with the entire purchase price including additional costs being payable. In addition, payment of the purchase price is possible with a credit or debit card accepted by Piccolohouse. Piccolohouse has the right to charge surcharges on individual payment methods. To protect your credit card data, the data is transmitted in encrypted form.

If Piccolohouse accepts payment of the purchase price on account, this must be paid within 15 calendar days. Piccolohouse can also make special arrangements with customers.

When purchasing in advance, the desired goods are only handed over or the order is only placed once the corresponding payment has been received. The desired items cannot be reserved during this time. If there is limited availability of goods, it may happen that goods with the status "in stock" can no longer be delivered immediately until the order is placed. If payment has not been received by Piccolohouse within 5 days, Piccolohouse can cancel the order.

If the customer is in default with payment in whole or in part, a late payment interest of 1% per month will be charged as well as reminder costs of CHF 10 per reminder, which are due immediately. In the event of debt enforcement, a processing fee of CHF 150 per order is also due without further reminder. Piccolohouse can also cancel and/or discontinue all further orders without further notice until the entire claim has been paid off. Piccolohouse also has the right to assign outstanding debts to external debt collection companies.

All delivered items remain the property of Piccolohouse until the purchase price (including all surcharges) has been paid in full. Pledging, transfer as security, processing or redesign is not permitted without the express consent of Piccolohouse. Piccolohouse is entitled to have the delivered goods entered in the retention of title register in accordance with Article 715 of the Civil Code.

7. Delivery conditions

Delivery is made exclusively to addresses in Switzerland and the Principality of Liechtenstein.

Piccolohouse’s delivery fees and conditions agreed upon conclusion of the contract apply.

The customer undertakes to check the goods immediately upon receipt for accuracy, completeness and integrity. Defects in the goods must be reported to the transport company and Piccolohouse as quickly as possible, but no later than 5 calendar days after receipt. In the event of complaints, all parts of the original packaging must be retained. These may only be disposed of after the written consent of the transport company or Piccolohouse.

The delivery period stated by Piccolohouse is only a guideline and is not binding. If Piccolohouse cannot meet a delivery deadline, the customer can withdraw from the purchase 60 days after conclusion of the contract after written notification to customer service.

8. Returns and Exchanges

There is no right to return goods. There will be no refund of the purchase price. The customer can ask Piccolohouse 30 days after handing over defect-free new goods whether they will be exchanged for goods in the same product category. The prerequisite is that the goods in question are marked accordingly on the purchase receipt/invoice, whereby the invoice must be presented. If you purchase online, you should contact Piccolohouse customer service. In any case, the original packaging must be present.

Piccolohouse does not have to justify the acceptance or rejection of an exchange. An exchange is carried out as a gesture of goodwill by Piccolohouse and does not constitute a legal claim. If an exchange is accepted, the customer must bear the costs of the exchange such as delivery and installation costs.

9. Warranty and Guarantee

Piccolohouse offers a guarantee of at least 2 years on new goods. The following are excluded from the guarantee (list is not exhaustive):

  • General wear parts

  • Normal power loss of batteries

  • Damage caused by incorrect manipulation, fall, impact, mechanical damage

  • Defects resulting from interventions or modifications

  • Changes made to the item, operating errors

  • Elemental events, frost, lightning, etc.

  • Failure to follow maintenance and usage instructions

Piccolohouse has the right in both warranty cases (i.e. defects that already exist when the product or goods are handed over to the customer) and warranty cases (i.e. defects that occur after the product or goods are handed over to the customer). to carry out repairs or replacement services. The customer has no right to cancellation or reduction.

The commissioning of repairs to third parties is carried out exclusively by Piccolohouse. The right to reimbursement of costs from third-party repairs is excluded. During the period of repair, the customer is not entitled to a replacement device. If the repair is made in a warranty case, the warranty for the repaired defect (not the entire goods) is extended to a maximum of 2 years from the date of purchase of the goods. If the repair is carried out in connection with a warranty claim, the guarantee period is only extended by the time of the repair. In the event of a replacement service, the guarantee or warranty period is only extended by the time the damage is repaired.

10. Liability

Claims for damages arising from impossibility of performance, breach of contract, negligence in concluding the contract and unlawful acts are completely excluded against Piccolohouse and against Piccolohouse's vicarious agents or vicarious agents, unless there is intentional or grossly negligent action. Liability for indirect damages and consequential damages resulting from use due to incorrect performance or loss of performance is excluded. In particular, the customer cannot assert any claims for compensation for consequential damage in warranty cases.

11. data protection

With regard to data protection, our data protection declaration is authoritative. The customer can request information from Piccolohouse about and, if necessary, correction of their own personal data.

12. Final provision and place of jurisdiction

Our business activities and thus the relationship between the customer and Piccolohouse are based exclusively on Swiss law.

In the case of disputes arising from consumer contracts, the court at the place of residence or registered office of one of the parties is responsible for the customer's claims, and the court at the place of residence of the defendant party is responsible for claims by Piccolohouse. Consumer contracts are contracts for services that are intended for the personal or family needs of the customer. For all other disputes, the court responsible for Watt is the exclusive place of jurisdiction.

If individual points of these terms and conditions are ineffective, this will not affect the effectiveness of the remaining provisions.
